Terms of Service

1. Acceptance of Terms

By accessing or using CrewConnect ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform.

2. Description of Service

CrewConnect is a maritime crew hiring marketplace that connects vessel operators and employers with maritime crew members. The Platform facilitates connections but does not employ crew members or guarantee employment.

3. User Accounts

You must create an account to access most Platform features. You are responsible for maintaining the security of your account credentials. You must provide accurate information and keep it updated.

4. Crew Members

Crew members agree to provide accurate information about their certifications, experience, and availability. Misrepresentation of qualifications is grounds for immediate account termination.

5. Employers

Employers agree to post only legitimate job opportunities. Fraudulent postings are prohibited and will result in account termination.

6. Privacy

Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference.

7. Prohibited Conduct

You agree not to: (a) post false or misleading information; (b) harass or abuse other users; (c) attempt to circumvent the Platform's matching system; (d) scrape or collect user data without authorization.

8. Intellectual Property

CrewConnect retains all rights to the Platform and its technology. User-submitted content remains your property but you grant CrewConnect a license to display it on the Platform.

9. Platform Status and Disclaimers

CrewConnect is a marketplace platform operated by AH360 Photography LLC. CrewConnect is not an employment agency, staffing firm, or employer. We do not employ crew members, do not guarantee employment, and bear no responsibility for the employment relationship between users.

CrewConnect is not a consumer reporting agency as defined by the Fair Credit Reporting Act (FCRA). Information on CrewConnect should not be used as a "consumer report." Employers are solely responsible for conducting their own verification, background checks, and due diligence before making any hiring decisions. CrewConnect does not verify the accuracy, completeness, or validity of any information, credentials, or documents posted by users.

User conduct disclaimer. CrewConnect is not responsible for the conduct, communications, or omissions of any user, whether online or offline. We do not pre-screen, vet, or continuously monitor user profiles, messages, or credential documents before they appear on the Platform. Crew and employers are each responsible for assessing the other party before engaging, reviewing any documents independently, and making their own safety and suitability judgements before meeting, contracting, or transacting off-Platform.

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied.

10. Limitation of Liability

CrewConnect and AH360 Photography LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability for any claim related to the Platform shall not exceed the greater of (a) the amount you paid to us in the twelve (12) months preceding the claim or (b) one hundred United States dollars ($100). CrewConnect is not responsible for the conduct of users, the accuracy of job postings, or the outcome of any hiring decisions made through the Platform.

Nothing in these Terms limits or excludes liability for gross negligence, willful misconduct, intentional fraud, or any other liability that cannot be excluded or limited by applicable Florida or United States federal law.

Class action waiver. To the extent permitted by applicable law, you and CrewConnect each waive any right to participate in a class action, class-wide arbitration, or any other representative proceeding. Any dispute between you and CrewConnect shall be resolved on an individual basis.

11. Indemnification

You agree to indemnify and hold harmless CrewConnect, AH360 Photography LLC, and its officers from any claims, damages, or expenses arising from your use of the Platform, your content, or your violation of these Terms.

12. Termination

We reserve the right to terminate accounts that violate these Terms or for any other reason at our discretion.

13. Governing Law

These Terms are governed by the laws of the State of Florida, United States. Any disputes arising from or related to these Terms or your use of the Platform shall be resolved exclusively in the state courts of Broward County, Florida, or the United States District Court for the Southern District of Florida, and you consent to the exclusive personal jurisdiction of those courts.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

15. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or in-app notification. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

17. Voluntary Endorsement System

CrewConnect does not run a traditional user-review system. Instead, the Platform supports voluntary endorsements that users (both crew and employers) may choose to leave about one another. There is no mechanism for users to submit negative reviews, no-show reports, or rating penalties, and no internal workflow that suppresses or removes otherwise-submitted negative content (because no such content is collected). Endorsements are used only to support discoverability and matching quality. Nothing published through the endorsement system constitutes employment history, a consumer report, or an official reference. Concerns about the accuracy of endorsements should be raised with us at the contact address above.

18. Beta Program Status

CrewConnect is currently operating as a closed beta with a limited group of invited users. While CrewConnect is in beta:

  • Service availability is best-effort. There is no uptime service-level agreement.
  • Features may change, be removed, or be re-worked without notice as we iterate based on beta feedback.
  • Non-essential data (such as test matches, placeholder jobs, and seed content) may be reset between beta phases.
  • Paid features are deferred; the Platform is free during beta as described on the signup page.
  • We welcome feedback. Bug reports and product suggestions can be sent to Steve@ah360views.com.

Your continued use of the Platform during the beta period constitutes acknowledgement of these beta terms.

19. Email Program

During closed beta, CrewConnect sends only transactional email — account security and authentication notices (email verification, password reset), notifications about activity in your account (introduction requests, direct messages, new matches, profile views, credential-expiration warnings, posting activity), account-status messages, and aggregate activity digests that summarise items that already happened in your account (such as daily and weekly activity summaries). Each of these messages is about an existing relationship with your account and falls outside the scope of commercial email as defined by the CAN-SPAM Act.

CrewConnect does not run a marketing, engagement, or promotional email program during closed beta. Commercial email features, if offered after beta, will include opt-out mechanisms and other disclosures required by applicable law at that time, and users will be able to opt out of non-transactional email from account settings.
